This Privacy Notice discloses the privacy practices of this website: www.captivate.com (the “Site”). Specifically, it describes the types of information that we gather about you when you access the Site, and the ways in which we use and share this information. This Privacy Notice does not apply to any information you may provide to us, or that we may collect, offline and/or through other means (for example, at a live event, via telephone, or through the mail).
Please read this Privacy Notice carefully. By visiting and using the Site, you agree that your use of our Site, and any dispute over our online privacy practices, is governed by this Privacy Notice and our Terms of Service. If we change the Privacy Notice, the “Last Updated” date reflects the date of the changes. By continuing to use the Site after we post any such changes, you accept the Privacy Notice as modified.

What Information We Collect
Information You Provide Voluntarily. We may collect and store information, including personal information (such as your name, postal address or email address) or other information, that you voluntarily supply to us while visiting our Site. How We May Use and Share Your Information
We use the information we collect from you while you are using the Site in a variety of ways, including, for example, to process your registration request, provide you with services and communications that you have requested, send you email updates and other communications about services or products that may be of interest to you, customize features and advertising that appear on the Site, deliver our Site content to you, measure Site traffic, measure user interests and traffic patterns, and improve the Site and the services and features offered via the Site.

How to Access and Control Your Personal Information
You have the following rights regarding your personal information:

- You can object to processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information.

Right to Opt-Out
You have the right to “opt out” of certain of our uses of your personal information. However, please understand that your option not to receive promotional and marketing messages from us: (a) shall not preclude us from corresponding with you, by email or otherwise, regarding your existing or past relationship with us (e.g., the status of your orders or our responses to questions or inquiries you pose to us), and (b) shall not preclude us, including our employees, contractors, agents, and other representatives, from accessing and viewing your personal information in the course of maintaining and improving the Site or providing the service or product you have requested.
Your California Privacy Rights
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our customers who are California residents to request and obtain from us once a year, free of charge, information about the personal information (if any) we may have disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. We currently do not honor browser-based Do-Not-Track signals.
Children’s Privacy
This Site is not directed to children under the age of 13 and we do NOT knowingly collect personally identifiable information from children under the age of 13 as part of the Site. If we become aware that we have inadvertently received personally identifiable information from a user under the age of 13 as part of the Site, we take reasonable steps to delete such information from our records and systems.
Data Security
We have implemented reasonable and appropriate security measures as set forth in a Written Information Security Plan (WISP) to ensure the security of the personal and other information we collect. Any third-party service providers with whom we may share personal information are contractually obligated to implement security measures no less robust and comprehensive. All information we gather on our Site is stored within a database(s) and server(s) to which only we and our hosting services provider have access. However, as effective as the reasonable security measures implemented by us may be, no physical or electronic security system is impenetrable. We cannot guarantee the security of our Site’s servers or databases, nor can we guarantee that information you provide will never be accessed, used, or released in a manner that is inconsistent with this policy.
If you register or create an account on our Site, you are responsible for maintaining the confidentiality of your login information, especially your user ID and password. It is recommended that you not share your login information with any other person. You are responsible for any access to or use of the Site by you or any person or entity using your login information, whether or not such access or use has been authorized by or on behalf of you, and whether or not such person or entity is your employee or agent. We will not be responsible for breach that results from a lost or stolen login information.
We will retain your personal information only for as long as your account is active, as needed to provide you services that you request, and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
